Competing juice makers Ocean Spray Cranberries and Decas Cranberry Sales are set for another legal battle, after Ocean Spray this week filed an action over “deceptive business practices”, though Decas has vowed to fight the case.
Ocean Spray is suing its rival, claiming that it engaged in an “unlawful and malicious” campaign to defame it with disparaging letters, emails, blogs, YouTube videos and Twitter postings.
Chuck Dillon, chief executive of Decas, told NutraIngredients-USA.com that the lawsuit was “totally frivolous” but the firm had not yet consulted its lawyers to determine its next course of action.
Richard Stamm, vice-president and general counsel for Ocean Spray said: “Decas has colluded with a group of growers and handlers to engage in a calculated and unlawful propaganda campaign to damage Ocean Spray’s reputation and relationships with our growers, customers and consumers.”
Ocean Spray is an agricultural cooperative of cranberry growers and grapefruit producers first set up in 1930, in the US state of Massachusetts.
