Nestle Juice Drinks Breach Regulations

The US Food and Drug Administration (FDA) has issued a warning letter which states that many of Nestle's Juicy Juice products are misbranded as their labelling breaks FDA regulations. In the letter, the FDA states that the Juicy Juice Brain Development Fruit Juice is misbranded under section 403 of the Federal Food, Drug, and Cosmetic Act as the label makes claims about its nutrient content that are unauthorised. Labelling on the product reads: "Helps support developmentĀ…in children under two years old." The beverage's website also makes similar claims and the FDA said that, except for statements that describe the percentage of a vitamin or mineral in relation to recommended daily allowance (RDI), claims of nutrient content should not be made for beverages aimed at infants and children less than two years of age, unless they are specifically permitted by FDA regulations. FDA criticizes Nestle For Labels on kid’s Drinks

the FDA said the company mislabeled its Boost drink, which comes in flavors including chocolate, vanilla, and strawberry, "as a medical food for the medical condition of 'failure to thrive' and also for 'pre/post surgery, injury or trauma, chronic illnesses.' '' According to federal guidelines, the letter explains, "Medical foods must be for the dietary management of a specific disorder, disease, or condition for which there are distinctive nutritional requirements and must be intended to be used under medical supervision.''
